“Appellants’ motion for a stay of the district court’s order of August 4, 2010 pending appeal is GRANTED. The court sua sponte orders that this appeal be expedited pursuant to Federal Rule of Appellate Procedure 2. The provisions of Ninth Circuit Rule 31-2.2(a) (pertaining to grants of time extensions) shall not apply to this appeal. This appeal shall be calendared during the week of December 6, 2010, at The James R. Browning Courthouse in San Francisco, California.

The previously established briefing schedule is vacated. The opening brief is now due September 17, 2010. The answering brief is due October 18, 2010. The reply brief is due November 1, 2010. In addition to any issues appellants wish to raise on appeal, appellants are directed to include in their opening brief a discussion of why this appeal should not be dismissed for lack of Article III standing. See Arizonans For Official English v. Arizona, 520 U.S. 43, 66 (1997).

And there you have it folks.  No same-sex marriages for now.  The 9th Circuit granted the Prop. 8 supporters a stay.  However, the Prop 8 appeal has been put on an expedited schedule and will be heard by 9th Circuit in December.

It has been brought to our attention that there is currently an enormous loophole that enables puppy mills (hell on earth for puppies) to avoid inspections if they sell puppies online.  This is horrific!!!!

Puppy mills, or commercial breeders, are basically a factory farm for dogs.  The only interest puppy mills have is to sell puppies at the fastest rate possible.  It has been widely documents and publicized that puppy mills have little to no respect for its puppies, and often cut every corner possible to make the highest profit.  In most circumstances, puppies are kept in cages no larger in size than they are, and are rarely let out of these cages and receive no love and care.

If this sounds horrific enough to you then help us speak out.  Recently, The PUPS Act was introduced in Congress after a recent audit discovered an alarmingly severe lack of enforcement of the Animal Welfare Act.  We urge you to sign the PUPS Act Petition to let your members of congress know that you want them to stand up and take action in the defense of these helpless dogs in the hopes of improving their lives.

Breaking News!! Judge Walker Lifts Permanent Stay In Gay Marriage!!!

Just moments ago Judge Walker lifted the permanent stay on same-sex marriages!!!!

In his decision Walker said:  “Plaintiffs seek to have the state recognize their committed relationships, and plaintiffs’ relationships are consistent with the core of the history, tradition and practice of marriage in the United States.”

Update:  Court has confirmed that the permanent stay has been denied.  However, a temporary stay will remain in effect until 5pm on August 18th in order to give the United States Court of Appeals time to review his decision. During this time, proponents of Prop. 8 have time to appeal the ruling to the U.S. Court of Appeals for the Ninth Circuit, and the Ninth Circuit has a chance to grant or deny that motion.

Breaking News…Will Gay Marriages Resume Immediately?

Judge Vaughn Walker has announced that he will release his decision today on whether or not gay marriages are to resume in California or if they will have to wait until decision from the U.S. 9th Circuit Court of Appeals.  Judge Walker said that he will release his decision this morning between the hours of 9a.m. and 12p.m. (pacific standard time).

Stay tuned for Judge Walker’s decision…

Update (12noon):  No official word from the court yet.  Will let you know as soon as we hear something.

Update 2:  Word on the street outside of the San Francisco court house is that the stay on marriage has been lifted and that same-sex marriages can resume!!!  No official word or confirmation yet.  Will post as soon as we get confirmation!

California Bans Single Use Plastic Bags!

Beginning January 1, 2012, stores in California will stop handing out single use plastic grocery bags due to a bill that passed out of the Senate Environmental Quality Committee.  This bill marks the first huge leap in trying to clean up the states litter problem.  It has been previously estimated that out of the near 20 million plastic grocery bags that are discarded annually, only 5% of those end up being recycled.  This statewide ban will encourage shoppers to use their own reusable shopping bags or it will leave them with an option of purchasing recycled paper bags at the time of checkout for five cents each.

There are many reports and studies that are just now starting to surface that suggest a healthier way to jog and run…barefoot.  Yes, that is right, doctors and scientists are now starting to say that running barefoot is not only easier on your body, but also minimizes the risks of injury.  Doctors and scientists are suggesting that we run better barefoot mainly because it is being discovered that running shoes interfere with our bodies natural mechanics.  Runners around the world are now wishing they would could return those $140 pair of running shoes!

While some of the findings of the various research and studies on barefoot running make sense, we still cannot picture people running through the streets of New York City or downtown Los Angeles barefoot.  Imagine the things you would step on???

27 Top Cancer Fighting Foods

The enlightened folks at Care2.com posted an interesting article on their website that educates its readers on the most beneficial cancer fighting foods.  Cancer seems to be everywhere these days…attacking our loved ones left and right.  A story that hits too close to home for many people.  Reading articles like this I can not help but wonder what the outcome would be for many cancer survivors/victims if we would have all received this vital information while we were in elementary school, all the way up through high school.  Sure, you were always told to eat your veggies…but you never really knew why.  Now we do.  And now that we know better…it’s time to do better.

So the next time someone says “eat your broccoli,” do yourself a favor and eat your broccoli.

Schwarzenegger & Brown Strongly Oppose Stay On Gay Marriage

Governor of California Arnold Scharzenegger and Attorney General Jerry Brown have both spoken out against the stay on gay marriage by filing briefs that oppose the stay on Judge Walker’s decision to overturn Prop. 8.  Shortly after Judge Walker’s ruling on Prop. 8, anti-gay marriage folks filed for a stay in which the judge temporarily granted (making it impossible for gay marriages to performed after the ruling).

In Arnold Schwarzenegger’s brief he says, “Allowing this Court’s judgment to take effect, and denying the extraordinary relief of a stay, furthers California’s vital interest in respecting the relationships of same-sex couples and does not burden any governmental interest. Accordingly, the Administration respectfully requests that the Court deny defendant-intervenors’ motion for stay pending appeal.”

We agree with Arnold 100%.

Judge Walker is currently examining the merits of continuing the stay.  It has been reported that if Judge Walker decides to lift the stay, it could happen as early as Monday morning.
